Introduction

This Privacy Policy sets out the conditions under which Delair may collect and process your personal data.

DELAIR SAS, a simplified joint-stock company registered in the Trade and Companies register of Toulouse under the number  877 643 486 and whose registered office is located on 676, rue Max Planck, 31670 Labège, herein referred to as Delair, commits to ensure protection, confidentiality and security of  personal data of its clients/users and to respect their privacy.

In this respect, Delair complies with the legislation in force in France and in Europe, particularly Law No. 78-17 of 6 January 1978 relating to data processing, data files and liberties, known as “Informatique et Libertés”, as well as Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, known as “RGPD”.

1. Definitions

Client: any natural or legal person who has signed a business contract with Delair and who benefits from the services and/or functionalities of the site and/or all Delair applications.

User: any natural person who visits Delair site and/or who fills in contact form and/or who uses the functionalities of the site.

2. Data collection and its nature

Delair collects data:

  • when you consult the https://delair.aero/ website,
  • when you create or log in to your account on “mydelair”,
  • when you will fill in any contact form or when you contact us by email,
  • when you sign a business contract (terms and conditions of sale, distribution agreement, non-disclosure agreement, etc.),

Collected information includes specifically:

  • identification data: family name, first name, email address, phone number, country, type of industry, company, position,
  • contact information: mailing address, email address, phone number.

Furthermore, Delair automatically receives and stores information from your computer and browser, including your IP address, software and hardware, and the requested page.

3. Use of data-Purpose of processing

Delair only processes personal data for specific, explicit and legitimate purposes. Delair will not process the data in any way which may be incompatible with purposes mentioned below.

All data that Delair collects from Clients/Users can be used to:

  • authentify the Client,
  • manage the Client’s identity and profile,
  • ensure the proper execution of sales to the Client,
  • provide pre-sales and after-sales services,
  • communicate for the purpose of client management,
  • provide authentication services,
  • store Client or User data; manage and respond to individual requests from Clients/Users,
  • manage and respond to individual requests from Clients/Users,
  • improve our website,
  • improve client service and support needs,
  • contact Clients via email or phone,
  • run promotions or conduct a surveys and enquiries.

Delair will only stock the data as long as necessary to fulfill the purposes mentioned above. For data processing related to contract execution/performance of contract, data may be stored for a period not exceeding three years after the termination agreement.

Delair also carries out data processing for purposes other than the strict execution of contracts. In this case Delair will ensure that it has a legitimate interest in carrying out the data processing, understood as a real interest and proportionate to the rights and interests of the Customer/User. This legitimate interest may in particular consist of communication with the Client/User for informational, promotional, advertising or other purposes.

In addition, other processings may be subject, as necessary, to the collection of the Client’s/User’s consent, that can be withdrawn at any time.

To that end, aims pursued by Delair are the following:

  • organising direct marketing operations,
  • organising commercial entertainment/activities (during exhibitions, private shows…),
  • organising contests,
  • analysing use of services to make pertinent proposals to clients,
  • surveying/polling clients or users.

Customer/User data is stored for the time strictly necessary to achieve the purposes mentioned above and in any event for a period not exceeding three years from the organisation of the operation in question.

4. Data recipients

Collected data is intended for Delair’s internal services and any subcontractors.

The data can be legally processed by Delair’s partners when their intervention is necessary for the execution of services. Some data processing may also require your consent.

Finally, processed data may be disclosed to the competent authorities, in the context of legal proceedings, judicial enquiries and requests for information from the authorities, only at their request, or in order to comply with other legal obligations. We may also disclose your personal data where such disclosure is necessary for the establishment, exercise or defense of legal claims, whether in court proceedings or in an administrative or out-of-court procedure. In all these situations, data is only transmitted to the extent strictly necessary for the purpose for which it is intended.

5. Data processing outside of EU

Delair works with partners and subcontractors around the world. Therefore, collected data might be processed outside the European Union. In this case, Delair takes the necessary steps along with its subcontractors and partners to ensure an adequate level of protection for your data in full compliance with applicable regulations.

If the subcontractors and partners concerned are not party to an agreement that has been the subject of an adequacy decision by the European Commission or are not located in a country with a legislation considered to offer adequate protection, they will have previously signed the “standard contractual clauses” of the European Commission or will be subject to binding internal rules approved by the authorities.

6. Rights and terms of exercise

The Client/User has the right to access, to rectification and the right to erasure of his/her data.

The Client/User has the right to data portability.

The Client/User also has the right to object to processing or to limit the processing.

Any request to exercise your rights must be accompanied by a photocopy of two proofs of identity (national identity card issued by the French State, passport, residence permit issued by the French State or traffic booklet issued by the French State).  You will receive a reply within one (1) month of receipt of your request.

At any time, the Client/User is free to unsubscribe from the mailing list by following the detailed instructions recalled at the bottom of any e-mail.

The Client/User who feels that their request was not satisfied By Delair can file a complaint before the French regulator called the Commission Nationale Informatique et Libertés (CNIL) online at https://www.cnil.fr/fr/plaintes or by post by writing to :

7. Online trade confidentiality

Delair is sole owner of data collected on this website.

Client/User’s personal information will not be sold, exchanged, transferred, or given to a third-party for any reason, without prior consent, except as necessary to meet a demand.

8. Security of Information

Delair implements a variety of security measures in order to maintain the security of its personal information, including when certain transactions are performed by subcontractors.

Delair uses encryption technology to protect sensitive information transmitted online.

Delair also protects offline information.
